Supreme Court reserves decision on Nikos Clerides search warrant appeal

The Supreme Court of Cyprus has reserved its decision regarding an application for a certiorari order filed by Nikos Clerides. The application seeks to annul a search warrant issued for his residence in connection with the 'Santi' case. During the hearing, legal counsel for the Republic stated that the Attorney General would not file an objection to the request. The state clarified that police investigators were instructed not to access or process private communications found on devices seized during the search. Conversely, defense attorney Alexandros Clerides maintained that the core issue is the legal validity of the warrant's issuance and execution rather than subsequent investigative procedures. The defense argues that the police entry into the premises and access to electronic devices constitutes an inherent violation of constitutional rights, regardless of whether the seized data was processed. The case remains under consideration by the court.
