Appeals court settles long-standing marble supply dispute

A 16-year legal dispute between a property owner and a marble supplier concluded with an Appeals Court ruling in favor of the supplier. The case originated from a 2010 contract for 'Bianco Perlino' marble used in the construction of a private residence. After installation by the owner's chosen contractor, the marble developed surface damage, prompting the owner to withhold the final payment of €13,093.43. The owner subsequently filed a counterclaim seeking over €80,000 in damages, alleging the materials were defective. The Court rejected the counterclaim, finding that the damage resulted from improper installation and moisture issues rather than material quality. The original court's decision, which favored the supplier's expert testimony over the owner's, was upheld on appeal. As a result, the owner is required to pay the outstanding balance, as well as accrued interest and legal costs. The decision puts an end to the protracted litigation that began shortly after the completion of the project in late 2010.
