Court of Appeal orders retrial in Paphos theft and conspiracy case

The Cyprus Court of Appeal has overturned an acquittal issued by the Paphos District Court regarding a case involving conspiracy to commit a felony and the theft of two electric bicycles. The incident occurred on June 18, 2023, when a storage area in a Paphos apartment building was reportedly burglarized. Initially, the District Court acquitted the defendant at the prima facie stage, citing significant gaps in evidence, particularly regarding identification. The lower court deemed the courtroom identification unreliable due to the lack of a formal police lineup. However, the Court of Appeal ruled that the lower court applied an incorrect legal standard by prematurely evaluating the weight of the evidence instead of determining if a prima facie case existed. The appellate judges clarified that the absence of a police lineup does not automatically invalidate identification testimony. Consequently, the Attorney General's appeal was accepted, the acquittal was annulled, and a retrial has been ordered before a different judge at the Paphos District Court.
