Nicosia District Court acquits driver in speeding case due to procedural errors
The Nicosia District Court acquitted a Romanian national charged with speeding at 119 km/h in a 50 km/h zone on August 30, 2024. The prosecution's case collapsed due to multiple procedural failures identified during the trial. First, the indictment incorrectly stated the location of the offense as Dali, while the mobile camera operator had actually positioned the device in Latsia. Furthermore, the court noted that the speed limit at the location was ambiguous, with documentation vaguely referencing a range between 50 and 65 km/h. Although the police argued the defendant was the registered owner of the vehicle, the court ruled that ownership does not automatically equate to being the driver at the time of the violation. The defendant provided a credible alibi, testifying that he was in Kato Paphos during the incident. Additionally, the court found discrepancies regarding the vehicle's registration history, despite police investigations into its status between May and November 2024. Consequently, the charges were dismissed, highlighting systemic flaws in the traffic enforcement process.
