Cyprus Court of Appeal rejects lawsuit against Lamborghini regarding 2008 accident

The Cyprus Court of Appeal has unanimously rejected an appeal filed by businessman Stavros Dimosthenous, who was murdered in Limassol in October 2025. The court upheld a lower court ruling, concluding that no mechanical defect was responsible for the total destruction of his Lamborghini Murciélago LP640 Coupé during a New Year's Eve accident on December 31, 2008. The judges found that the crash was caused by excessive speed rather than negligence by the manufacturer, Automobili Lamborghini SPA, or the local repair company, Unicars Limited.

The legal battle began in 2009 when Dimosthenous and his wife sought damages for physical injuries and the loss of the vehicle. The plaintiffs had alleged that a malfunction in the rear right wheel, axle, or fuel tank led to the car veering off the road, striking a dirt embankment and a wall, and subsequently catching fire. Despite these claims, the court ruled that the mechanical failure argument remained unproven, effectively closing the long-standing litigation following the owner's death last year.
