Cyprus Court of Appeal holds Provident Fund administrators personally liable
On September 30, 2026, the Court of Appeal of Cyprus issued a landmark ruling overturning a previous lower court decision regarding the Provident Fund of the Cyprus Popular Bank. The court unanimously held three members of the Fund’s Management Committee personally liable for damages resulting from negligent omissions in the management of the fund's assets. The defendants were ordered to pay a total of €194,708.44, plus interest calculated from December 31, 2008, along with legal costs.
The litigation stemmed from a case initiated by Harutune L. Arakelian, a former bank employee with 42 years of service who retired on December 31, 2008. Following his death, the legal proceedings were continued by the administrator of his estate, Andriani Arakelian. In its decision (Civil Appeals 401/2019 and 402/2019), the Court of Appeal rejected the initial finding that the negligence was an abstract failure of the Fund, instead ruling that the omissions were direct actions of the specific natural persons who comprised the committee at the relevant time. This ruling establishes a significant precedent for beneficiaries seeking accountability from fund administrators regarding fiduciary duties and professional negligence.
